Brayogo Safaris Booking Terms and Conditions
Brayogo Safaris Co Ltd (hereinafter referred to as the “Tour Firm”) accept bookings subject to the following terms & condition.

1. BOOKING

All reservations are made on a provisional basis and will only be confirmed on receipt of a signed booking form or email and non-refundable deposit equal to 30% of tour price.

2. PAYMENT

Balance of payment is due 45 days prior to client arrival. Where bookings are made less than 30 days prior to departure full payment is due with the booking form. A late fee US Dollars 50 will be charged for all booking made within 15 days of client arrival.

3. CANCELLATION

In the event of cancellation by the client the following cancellation charges will apply:
45 – 30 days prior to client arrival - 33 % of tour price.
30 – 15 days prior to client arrival - 50 % of tour price.
15 – 0 days prior to arrival of client - 100 % of tour price.

Cancellation charges will be calculated from date of receipt by the company of cancellation in writing, either by facsimile and/or email with received confirmation by the company.

4. CANCELLATION BY COMPANY

The company reserves the right to cancel any tour management up to 30 days prior to client departure in this event, and provided that cancellation is not due to non-payment the company will refund monies paid less any un-recoverable cost or offer an alternative or comparable tour.

5. PRICES

Prices are based on cost and exchange rates valid at the date of quotation. Should there be any variation in this cost a surcharge may be made. If this surcharge amount to more than 10 % of the tour price the client has the right to cancel within 7 days of notification without penalty. The company guarantees not to increase prices after full payment and completed booking form is received. This guarantees excludes fuel surcharges and does not include any taxes, charges or levies imposed by any government or their agendas.

6. FORCE MAJEURE

The company further reserves the right to alter any route, vehicle or equipment from that published or cancel all or part of a tour due to circumstances beyond it’s control. These may include, but are not limited to ward civil disturbance, border closures, and natural disaster, and climatic condition, changes in laws, sickness, epidemic and mechanical failure. The company shall not by liable for any expenses incurred by client in any such event not will any refund be made for any part of the tour which is cancelled by circumstances amounting to “force majeure”.

7. CONDITIONS OF CARRIAGE/ ACCOMMODATION

All decisions as to route and itineraries will be those of the company or it’s tour leader. Clients acknowledge that the company tour leader may decline to carry any client who fails to comply with local laws and customs or whose continued presence would be detrimental to the safety or well being of other members. In such an event the company’s liability to client ceases and the Hotel/Lodge/Tented camp or other place of accommodation such booking are made by the company acting solely as an gent of the client and the company will not be held responsible for any failure by the Hotel or another place of accommodation which has been booked.

8. RESPONSIBILITY
Clients are responsible for making their own way to the pre-arrange meeting point of the tour at the scheduled time. When the client makes a booking for a tour which includes air transportation or the company arranges the air transportation on behalf of the client and cannot under any circumstance be held responsible for any cancellation or addition expenses incurred by re-scheduled or cancellation of flights. Clients are also responsible for re-confirming onward or return sectors of any air journey with carrier concerned. Client are strongly advised to ensure that their travel insurance cover includes cancellation / curtailment.

9. RELEASE OF LIABILITY

Client acknowledge that they are aware that during any tour, safari, expedition or adventure in which they participate certain risks and dangers may arise including, but not limited to, the hazards of traveling in mountain or other tough terrain, high altitude and underwater experiences, travel by animal, balloon, raft, canoe, boat, light air craft or other means of conveyance, the forces of nature, wild animal, civil unrest, terrorism and accident unless in remote region without means of rapid evacuation or availability of medical supplies that may be provided nor will be liable for any loss, damage or injury including consequential loss of any however or whoever the cause .

10. INSURANCE

It is essential that clients take out adequate travel insurance against cancellation charges, unexpected curtailment of tours, medical expenses arising overseas, loss or damage to luggage and third party liability. The company will not be liable for any claim made from client's failure to arrange insurance.

11. COMPLAINTS

The company makes every effort to ensure that client’s tour or safari will be trouble free. However, if the clients have a complaint arising out of what has agreed to provide such complaint should be addressed in writing to the company within 28 days of the end of the tour.

12. DISPUTES & RESOLUTION

Disputes arising out of or in connection with contract made by these booking conditions, which cannot be amicably settled, shall be interpreted and determined, by Kenya law and both parties, shall submit to the jurisdiction of the Kenya Courts.

By booking an itinerary, I (the client) agree that I have accepted the above terms and conditions.
